THE IMPORTANCE OF SELECTING THE RIGHT MEDICAL EXPERT

Section 18.001 of the Texas Civil Practice and Remedies Code affords plaintiffs with a streamlined procedure for proving the reasonableness and necessity of medical expenses. Although an initial affidavit is not conclusive, the failure to serve a proper counteraffidavit can prove fatal for a defending litigant. Many plaintiff’s attorneys will meet a counteraffidavit with a motion to strike, which, if granted, places the defendant in a precarious position.

Texas appellate courts have split on whether mandamus relief is appropriate when a counteraffidavit is stricken, with most courts finding that a defendant’s remedy lies in a direct appeal. This often means that the issue of a stricken counteraffidavit will not be revisited until after a full trial on the merits and an appeal by the defense. Naturally, this can drastically shift the power of the parties in settlement negotiations.
